According to the USCIS Update dated April 8th 2008 – “USCIS has received enough H-1B Petitions to meet the congressionally mandated cap for fiscal year 2009”. USCIS also received 20,000 H-1B Petitions filed with ‘advanced degree’ exemption. USCIS will conduct a computer-generated random selection process to meet the 65,000 cap for general category and 20,000 under the ‘advanced degree’ category. The agency will conduct the selection of 20,000 under advanced degree first, and then all petitions not selected will be included in the random selection process for the 65,000 visa cap.
